Terms of Use

These Terms of Use (the "Terms"), which include the End User License Agreement ("EULA") for the app in section 12, govern your access to and use of the Build The Shelf website, the Build The Shelf waitlist, and the Build The Shelf mobile app for iOS (collectively, the "Service"). By using the Service, joining the waitlist, or creating an app account, you agree to these Terms. If you do not agree, you must not use the Service.
1. Who we are
The Service is provided by [legal entity name — e.g. Build The Shelf LLC] ("we", "us", "our"), of [registered business address]. For questions, complaints, or claims relating to the app, contact us at support@buildtheshelf.com or hello@buildtheshelf.com.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service you represent that you are of legal age and are physically able to participate in the type of training the Service describes.
3. The Service
The Service consists of:
- This website, including informational articles about glute training, exercises, nutrition, recovery, and related topics.
- A waitlist you can join to be notified when the Build The Shelf app becomes available.
- The Build The Shelf iOS app, which delivers adaptive training programs focused on glute development, hip mobility, and lower-body strength, along with written content, form guidance, and progress tracking.
Joining the waitlist does not constitute a purchase, does not guarantee access to the app, and can be cancelled at any time by unsubscribing from waitlist emails or by emailing us.
4. Health and medical disclaimer
Build The Shelf does not provide medical advice. The Service — including all programs, workouts, written content, and form guidance — is provided for general fitness and informational purposes only. It is not medical, physiotherapy, diagnostic, treatment, or nutrition advice, and it is not a substitute for advice from a qualified healthcare professional. Using the Service does not create a doctor–patient or any other professional healthcare relationship.
Resistance training carries inherent physical risk. You should consult a qualified medical professional before beginning any new program, and stop and seek medical attention if you experience pain, dizziness, or other warning signs — particularly if you have an existing injury or medical condition, are pregnant or postpartum, or are recovering from surgery. Never disregard or delay seeking professional medical advice because of something you have read or seen in the Service.
By using the Service you acknowledge that you participate at your own risk and that Build The Shelf is not liable for any injury, illness, or health consequence arising from use of the Service, to the fullest extent permitted by law.
5. Your account
Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@buildtheshelf.com if you believe your account has been compromised.
6. Deleting your account
You can delete your account and its associated personal data at any time directly in the app: Settings → Account → Delete Account. Deletion permanently removes your account — it is not a temporary deactivation — subject to the limited records we are legally required to retain. See our Privacy Policy for details.
7. Subscriptions and payments
App subscriptions are sold as auto-renewable in-app purchases through the Apple App Store, and are subject to Apple's Media Services Terms and Conditions in addition to these Terms. Our paywall and subscription offers are presented using Superwall; all payments are processed by Apple. The following applies to any subscription you purchase:
- What you get: [subscription name(s) and what each unlocks].
- Length and price: [billing period(s) and price(s), e.g. Monthly — $X.XX / Annual — $Y.YY], as shown on the purchase screen in the app.
- Billing: payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the price stated above.
- Managing your subscription: you can manage your subscription and turn off auto-renewal in your Apple ID Account Settings after purchase (Settings → your name → Subscriptions).
- Free trials, if offered: any unused portion of a free trial period is forfeited when you purchase a subscription, where applicable.
We do not directly process or store full payment card details — those are handled by Apple. The Privacy Policy and these Terms of Use apply to your subscription.
8. Cancellation and refunds
You can cancel a subscription at any time from your Apple ID Account Settings. Cancellation stops future renewals; it does not automatically refund the current paid period. Refunds for App Store purchases are handled by Apple under its published policies, not by us.
9. Acceptable use
You agree not to:
- Share your account or app access with others
- Copy, distribute, resell, or republish program content, written material, or video
- Use the Service to harass, defame, or harm other users or our staff
- Reverse engineer, scrape, or attempt to extract our data via automated means
- Use the Service in any way that violates applicable law
10. Intellectual property
All content on the Service — including written material, programs, video, photography, branding, and design — is owned by Build The Shelf or our licensors and is protected by copyright and trademark law. We grant you a personal, non-transferable, non-exclusive licence to use the Service for your own training. No other rights are granted.
11. User-generated content
If you submit form videos, progress photos, written feedback, or other content to us, you grant us a worldwide, royalty-free licence to use that content for the purpose of delivering the Service to you and, where you have separately opted in, for marketing material. You can withdraw marketing consent at any time by emailing us. You remain responsible for the content you submit and represent that you have the right to share it.
12. Apple App Store terms (End User License Agreement)
The Build The Shelf app is licensed, not sold, to you. This section forms the EULA between you and us for the app and applies in addition to the rest of these Terms. Where this section and Apple's standard Licensed Application End User License Agreement differ, the terms that give you greater protection apply.
- Parties. This EULA is between you and [legal entity name] only, and not with Apple. We, not Apple, are solely responsible for the app and its content.
- Scope of licence. We grant you a non-transferable licence to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions (except that the app may be accessed by other accounts via Family Sharing or volume purchasing).
- Maintenance and support. We are solely responsible for providing any maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any); to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
- Intellectual property claims. In the event of any third-party claim that the app or your use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the app.
- Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
13. Third-party services
The Service integrates with third parties including the Apple App Store (subscriptions and purchases), Superwall (paywall and offer presentation), Supabase (accounts and data), Basin (waitlist form submissions), Loops (email marketing), Google Analytics and Google Search Console (website measurement), a third-party workout content API, and our in-app product-analytics provider. Their handling of your data is governed by their own privacy policies and terms, and is described further in our Privacy Policy.
14. Termination
We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe your use of the Service poses a risk to others. We may also discontinue the Service or change its features at any time, on reasonable notice where practicable. Your licence to use the app ends automatically if you fail to comply with these Terms.
15. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
16. Limitation of liability
To the fullest extent permitted by law, Build The Shelf will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any direct damages is capped at the amount you paid us (or, for App Store subscriptions, the amount paid through Apple) in the 12 months prior to the claim.
17. Governing law
These Terms are governed by the laws of [governing-law jurisdiction — e.g. the State of ___, USA], without regard to its conflict-of-laws rules. Any dispute arising under these Terms is subject to the courts having jurisdiction there, except where applicable consumer-protection law entitles you to bring proceedings in your country of residence.
18. Changes to these Terms
We may update these Terms from time to time. If we make a material change we will notify waitlist members and app users by email and update the effective date above. Continued use of the Service after a change constitutes acceptance of the updated Terms.
