Terms of Service
Effective
These Terms of Service (the "Terms") govern your access to and use of the Build The Shelf website, the Build The Shelf waitlist, and, in the future, the Build The Shelf mobile app (collectively, the "Service"). By using the Service, joining the waitlist, or creating an app account once available, you agree to these Terms. If you do not agree, you must not use the Service.
1. Who we are
The Service is operated by Build The Shelf ("we", "us", "our"). You can contact us at hello@buildtheshelf.com.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service you represent that you are of legal age and are physically able to participate in the type of training the Service describes.
3. The Service today: website and waitlist
Today the Service consists of:
- This website, including informational articles about glute training, exercises, nutrition, recovery, and related topics.
- A waitlist you can join to be notified when the Build The Shelf app becomes available.
- Email communication related to the waitlist and (with your consent) updates on the build.
Joining the waitlist does not constitute a purchase, does not guarantee access to the app, and can be cancelled at any time by unsubscribing from waitlist emails or by emailing us.
4. The Service in the future: the mobile app
Once the Build The Shelf mobile app launches, the Service will include access to adaptive training programs focused on glute development, hip mobility, and lower-body strength, along with written content and form guidance delivered inside the app. App-specific terms (including subscription terms, cancellation, in-app purchases, and data handling) will be presented to you at the point of sign-up and supplement these Terms.
5. Health disclaimer
Resistance training carries inherent physical risk. You should consult a qualified medical professional before beginning any new program, particularly if you have an existing injury, medical condition, are pregnant, or are recovering from surgery. Program content is provided as guidance — it is not personalized medical, physiotherapy, or nutrition advice. By using the Service you acknowledge that you participate at your own risk and that Build The Shelf is not liable for injury or illness that arises from use of the Service.
6. Accounts (post-app-launch)
Once the app is available, some features will require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@buildtheshelf.com if you believe your account has been compromised.
7. Purchases and subscriptions (post-app-launch)
App subscriptions will be sold and managed through the Apple App Store and (where available) Google Play. Pricing, billing cycles, free trials, and cancellation terms will be presented inside the relevant store at the point of purchase. We do not directly process or store full payment card details — those are handled by the store you purchase through. Subscriptions auto-renew until cancelled.
8. Cancellation and refunds (post-app-launch)
You can cancel an app subscription at any time directly from your device's subscription settings. Cancellation stops future renewals; it does not automatically refund the current paid period. Refunds for app purchases are handled by the App Store or Google Play under their published policies.
9. Acceptable use
You agree not to:
- Share your account or app access with others
- Copy, distribute, resell, or republish program content, written material, or video
- Use the Service to harass, defame, or harm other users or our staff
- Reverse engineer, scrape, or attempt to extract our data via automated means
- Use the Service in any way that violates applicable law
10. Intellectual property
All content on the Service — including written material, programs, video, photography, branding, and design — is owned by Build The Shelf or our licensors and is protected by copyright and trademark law. We grant you a personal, non-transferable, non-exclusive licence to use the Service for your own training. No other rights are granted.
11. User-generated content (post-app-launch)
If, once the app launches, you submit form videos, progress photos, written feedback, or other content to us, you grant us a worldwide, royalty-free licence to use that content for the purposes of delivering the Service to you and, where you have opted in, for marketing material. You can withdraw marketing consent at any time by emailing us.
12. Third-party services
The Service integrates with third parties including our email service provider (waitlist emails) and, in the future, the Apple App Store / Google Play (subscription handling). Their handling of your data is governed by their own privacy policies and terms.
13. Termination
We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe your use of the Service poses a risk to others. We may also discontinue the Service or change its features at any time, on reasonable notice where practicable.
14. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of liability
To the fullest extent permitted by law, Build The Shelf will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any direct damages is capped at the amount you paid us in the 12 months prior to the claim.
16. Changes to these Terms
We may update these Terms from time to time. If we make a material change we will notify waitlist members and (once available) app users by email, and update the effective date above. Continued use of the Service after a change constitutes acceptance of the updated Terms.
17. Governing law
These Terms are governed by the laws of the United States. Any dispute arising under these Terms is subject to the courts having jurisdiction at Build The Shelf's principal place of business.
