Terms of Service
Effective
These Terms of Service (the "Terms") govern your access to and use of the Build The Shelf website, training programs, coaching services, and any content we publish (collectively, the "Service"). By creating an account, purchasing a program, or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. Who we are
The Service is operated by Build The Shelf ("we", "us", "our"), based at 42 Studio Lane, London EC2 7AB. You can contact us at hello@buildtheshelf.com.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service you represent that you are of legal age and are physically able to participate in the type of training the Service describes.
3. The Service
The Service offers structured training programs focused on glute development, hip mobility, and lower-body strength, along with form review, written content, and optional one-to-one coaching. Program content is provided as guidance — it is not personalized medical, physiotherapy, or nutrition advice.
4. Health disclaimer
Resistance training carries inherent physical risk. You should consult a qualified medical professional before beginning any new program, particularly if you have an existing injury, medical condition, are pregnant, or are recovering from surgery. By using the Service you acknowledge that you participate at your own risk and that Build The Shelf is not liable for injury or illness that arises from use of the Service.
5. Accounts
Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@buildtheshelf.com if you believe your account has been compromised.
6. Purchases, payments, and refunds
Programs are sold on a one-time or subscription basis as labelled at the point of purchase. Payments are processed by our payment provider, which is currently Stripe; you should review Stripe's terms separately. Prices are listed in the currency shown at checkout and include applicable taxes where required.
We offer a 14-day, no-questions-asked refund on every program purchased directly from Build The Shelf. To request a refund, email hello@buildtheshelf.com from the address you used at checkout within 14 days of purchase.
7. Cancellation
Subscription-based access continues until you cancel. You can cancel at any time through your account or by emailing us. Cancellation stops future renewals; it does not refund the current paid period unless you also qualify under Section 6.
8. Acceptable use
You agree not to:
- Share your account or program access with others
- Copy, distribute, resell, or republish program content, written material, or video
- Use the Service to harass, defame, or harm other members or our staff
- Reverse engineer, scrape, or attempt to extract our data via automated means
- Use the Service in any way that violates applicable law
9. Intellectual property
All content on the Service — including written material, programs, video, photography, branding, and design — is owned by Build The Shelf or our licensors and is protected by copyright and trademark law. We grant you a personal, non-transferable, non-exclusive licence to use the Service for your own training. No other rights are granted.
10. User-generated content
If you submit form videos, transformation photos, written feedback, or other content to us, you grant us a worldwide, royalty-free licence to use that content for the purposes of delivering the Service to you and, where you have opted in, for marketing material. You can withdraw marketing consent at any time by emailing us.
11. Third-party services
The Service integrates with third parties including, currently, Stripe (payments) and our email service provider (newsletters). Their handling of your data is governed by their own privacy policies and terms.
12. Termination
We may suspend or terminate your access to the Service if you breach these Terms, if your payment fails, or if we reasonably believe your use of the Service poses a risk to others. On termination your licence to use the Service ends immediately.
13. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of liability
To the fullest extent permitted by law, Build The Shelf will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any direct damages is capped at the amount you paid us in the 12 months prior to the claim.
15. Changes to these Terms
We may update these Terms from time to time. If we make a material change we will notify active members by email and update the effective date above. Continued use of the Service after a change constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of England and Wales. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts of England and Wales.
